FIIDS Urges U.S. Relaxation of Rules for Indian-American Green Card Backlog
In a plea to the Biden Administration, the Foundation for India and Indian Diaspora Studies (FIIDS), representing the interests of Indian-Americans caught in the enduring green card backlog, has urged for a relaxation of rules pertaining to employment authorization cards.
Plea to Biden Administration
With approximately 1.1 million Indian-origin non-immigrant visa holders anxiously awaiting their priority dates to become current for filing I-485 green card applications, the seven percent country-wise cap on approvals has caused staggering delays, amounting to nearly 135 years. Over 400,000 individuals are projected to never attain permanent residency during their lifetimes.

FIIDS emphasizes that the issuance of Employment Authorization Cards at the outset of green card processing could alleviate the anxieties and uncertainties faced by a significant number of Indian-Americans, their spouses, and grown-up children.
“Recognising the imperative of maintaining America’s competitive advantage, it is crucial to acknowledge the immense contributions these individuals and their families make to the nation’s economy by driving innovation and enhancing diversity,” Khanderao Kand, FIIDS Chief of Policy and Strategies, said in a letter to Ur Jaddou, Director of the US Citizenship and Immigration Services (USCIS).
Supporting Contributions to the U.S. Economy
Kand suggested, “For Employment-Based Applicants: Grant EAD to I-140 approved applicants for a duration of five years without necessitating waiting for I-485 processing. For Spouses of Applicants: like the announcement on 27th September, give five years auto-renewal EAD to H4-EAD spouses to provide them with the freedom from the uncertainty and contribute independently.”
He further advocated, “For Documented Dreamers: Allow H4-EAD and extend their visa coverage from 21 years to 25 years, providing them with a stable status until they can pursue their own immigration path.”
Urgent Appeal to USCIS
Kand implored the USCIS to consider this appeal urgently, taking into account the human toll of prolonged immigration delays and the significant potential these individuals offer to American society.
He concluded by emphasizing that implementing these changes would not only relieve the immense pressure faced by these families but also strengthen the United States as a nation that values and nurtures talent and diversity.
